TERMS OF SALE
Our terms are payment on delivery. All orders for new accounts should be accompanied by payment in full, including shipping charges, at the time the order is placed. No checks are accepted from new accounts without previous clearance. No checks are accepted from any bank that will not conduct a merchant check verification. All checks returned by the bank for insufficient funds will have additional $35 service charge added to the outstanding amount.
Eligible customers, as determined by Mortellaro’s, may receive a 2% payment credit on invoices paid by cash, check, or ACH. Payment credits are applied to the customer’s account for future purchases only, are not redeemable for cash, and expire two (2) years from the date of issuance. Other account credits, including pot returns, promotional programs, pricing adjustments, and miscellaneous account credits, are likewise intended for future purchases and will expire if not redeemed or applied within two (2) years of issuance. Mortellaro’s reserves the right to determine program eligibility and modify or discontinue promotional credit programs at any time.
Mortellaro’s will open credit accounts with established companies who complete our Credit Application and Account Agreement, have sufficient credit history and capacity, and maintain a suitable payment history. Please allow at least 30 days for the application approval process. The terms of Mortellaro’s Credit Applicaton & Purchase aggrement are non-negotiable, and must be signed by an officer of the company.
Payments are due 30 days from the date of the invoice or on the 10th, depending on your terms. Past due amounts are subject to a Finance Charge of 1.5% per month or such maximum lesser rate as may be permitted by law. Invoices are considered overdue 15 days after the due date. Accounts 90 days past due will be subjected to collection procedures.

Purchasing Policy
We restrict sales to companies actively involved in the nursery or landscape business. Customers must provide a copy of their Floral Nursery Certificate and tax identification number prior to purchasing or obtaining availability or price list.
Prices
Prices are no longer printed in our catalog, and are listed on our Availability that can be obtained from our office by fax, email, text, or online with registered accounts. Prices are intended for wholesale trade only, for quantities of 11 or more. For quantities under 11, add 10%. Prices change without notice. Availability is updated daily with prices that cancel all previous quotations.
Tagging Specific Plants
We select the best plants for all orders. In order to maintain competitive pricing for all of our customers, we find it necessary to add 10% to the price if you wish to tag your own plants. Tags will be removed from plants not taken within 10 days.
Caliper Measurements
Mortellaro's follows the ANSI (American National Standards Institute) guidelines for measuring the calipers for trees. Also found online as ANSI Z60.2, with latest version available below. The relevant information is :
1.2.1 Measuring caliper
For all other nursery stock, caliper measurement shall be taken six inches above the ground level for field
grown stock and from the soil line for container grown stock, which should be at or near the top of
the root flare, and six inches above the root flare for bare root plants, up to and including the four-inch
caliper size interval (i.e., from four inches up to, but not including, 4. inches). If the caliper measured
at six inches is four and one-half inches or more, the caliper shall be measured at 12 inches above the
ground level, soil line, or root flare, as appropriate.
Seldom are tree trunks perfectly round. The most accurate measurement will result from the use of a
diameter tape. Caliper measurements taken with manual or electronic “slot” or “pincer” type caliper
tools should be the average of the smallest and largest measurements.
1.2.3.3 Method of caliper measurement
C. The caliper specified is one-half (1⁄2) of the caliper of the three largest required trunks.
We understand some landscape artchitects wish to follow the DBH, and this must be specified when requesting a quote as we generally do NOT follow it :
DIAMETER BREAST HEIGHT (DBH). The outside bark diameter at breast height. Breast height is defined
as 4.5 feet (1.37m) above the forest floor on the uphill side of the tree. For the purposes of determining
breast height, the forest floor includes the duff layer that may be present, but does not include
unincorporated woody debris that may rise above the ground line.
Volume Sale Discounts
Our volume discount program is based on customer’s annual purchases from January 1 to December 31. All accounts are reviewed and appropriately adjusted monthly.
• 5% discount is given on annual purchases over $15,000
• 10% discount is given on annual purchases over $35,000
The earned discount will continue to be applied into the next year. If a customer does not maintain adequate purchases to qualify for the discount on their account at the end of the next year, the discount will be lowered accordingly. All discounts will be forfeited on past due accounts.
Delivery
We own our fleet of trucks and do not ship by common carrier. Mortellaro’s request at least 24 hour notice for delivery arrangements to be made, however actual date will depend on driver avability. Our drivers are instructed to tailgate only. Customers are required to supply adequate help in unloading the truck to avoid delaying the driver, and must provide unloading equipment for plant material above 300 pounds. Customers also must provide reasonable unloading areas accessible by our trucks and trailers. See Delivery Rates on next page for more information on delivery, fuel, and delay fees.
Claims
All Claims, for any cause, must be made immediately upon receipt of goods. Check your order at time of delivery or time of pick up. Buyer acknowledges that any person who signs the delivery document has authorization. Plant material approved for return must be returned in the same condition in which it was received. Returns that are not protected from wind, sun, or dehydration are unconditionally rejected.
Restocking Fee
Mortellaro’s strives to provide the highest quality plant material available. Returns or exchanges requested for reasons other than plant quality are subject to a restocking fee.
Delivery Orders
Orders are normally pulled two business days before delivery (4 for fire-ant quarantine zones) and loaded one day before delivery.Orders cancelled after being pulled are subject to a 15% restocking fee. .
Orders canceled after being loaded are subject to 20% fee restocking fee.
Items refused/returned at delivery for reasons other than plant quality are subject to a 15% restocking fee.
Pickup Orders
When time and resources permit, Mortellaro’s will assemble pickup orders prior to customer arrival upon request. Orders not picked up in 48 hours are subject to a 15% fee. Declining the restocking fee will result in future orders assembled upon arrival.
